Legal Question in Credit and Debt Law in Georgia
Garnishment
I recently have had a garnishment attach to my wages. I was never notified by the company that they would be garnishing my wages and was not given the chance to answer the garnishment because of this. I am the single mother of 2 children and I barely make it every month as it is. This garnishment took $290 out of 1 paycheck. I have read that I am able to file a claim of exemption and prove to the courts that I cannot pay this much at a time because it would cause undue hardship on me and my dependants. Unfortunately, no one seems to be able to tell me where to find this form or how to file. I don't know what I am going to do, this will be taking $600 of my monthly income and I barely make it as it is. I will have no money to buy food for my kids or to afford daycare so that I may keep my job.

Re: Garnishment
There is no such form, and companies do not have to warn you that they received a garnishment. A garnishment means that you previously lost a lawsuit, so it should not be unexpected, as that is a normal event after losing suit. The only ways (in most cases) to stop a valid garnishment are (1) to pay the debt, and (2) to file bankruptcy. My office handles bankruptcy if you are considering that.
