Legal Question in Credit and Debt Law in Georgia

Garnishment

In the state of Georgia, can a credit card company who has charged off your account garnish your wages. My account was charged off, but sold to a collection agency. Now a Law firm is threatening to garnish my wages.

The account was not opened in Georgia

Re: Garnishment

Many people misunderstand the word "Charged off." It does not mean the debt went away. It is essentially a way on a credit report for a creditor to call you a deadbeat. Legally, it's simply an accounting move on their part to allow them to write off a loss on taxes that they have previously claimed as income.

They are still free to collect the debt, and often at that stage debts are pursued vigorously.

If the debt is large, or you have other debts, you may want to look into whether bankruptcy or debt relief would help you. If you're in metro Atlanta go to www.glenashman.com for a free worksheet, and then call us at 404-768-3509 and we'll look it over and discuss your options. In the meantime, do not talk with collectors without legal advice.
