Legal Question in Credit and Debt Law in Georgia

Garnishment

I was subjected to a wage ganishment due to a vehicle that I had reposssessed due to change in employment from someone who would not pay me. I kept in contact with the finance company about my situation. They claimed they would work with me; however, they took the vehicle back in the middle of the night. A judgement was awarded to them 2 yrs. later in which I had not received notice. The papers from the courthouse said they served my wife. However the discription they gave did not match her at all. I was in the process of purchasing my first home when I received word from my employer that I was being garnished of my wages. I felt I was not given due process or notification. Money was taken out of my grandmother's savings account because my name was on it. She is almost 92 yrs old and is unable to handle her transactions at the bank. I have since lost my financing on my home purchase as well as fallen behind on my other obligations. I tried to file a response in state court but the clerk--name removed--me that I must know the exact forms to fill out and refuse to let me answer the judgement in the allotted time. Can I take this back to court to receive my due process?

Re: Garnishment

You have a lot of legal issues to deal with in this paragraph. You possibly could pursue the person who would not pay you.

You also should be able to get this back to court but you may want an attorney to help you.

Shoot me an e-mail and I may e able to point you in the right direction.
