Legal Question in Credit and Debt Law in Georgia

Georgia Statute of Limitations on open credit card debt

I moved to Georgia in 2001 and have a credit card debt from 2000. The credit bureau lists it as an open account type. Is the statute of limitations 4 years or 6 years on credit card debt in the state of Georgia and does the amount of time in residence in Georgia play any part in it (like the Florida tolling provisions). In other words, would I have to be a Georgia resident for 4 or 6 years for the SOL to apply to me.

Re: Georgia Statute of Limitations on open credit card debt

All actions upon open account, or for the breach of any contract not under the hand of the party sought to be charged, or upon any implied promise or undertaking shall be brought within four years after the right of action accrues. With regard to tolling, I don't believe the statute of limitations would begin to run in Georgia until you became a resident of Georgia.
