Georgia- Summons for Credit Card Debt

I just received a court summons for an uncollected credit card debt. My last payment on this debt occurred in August 2001, and I have not contacted any of the various collection agencies that have taken over the debt. Does this meet the statute of limitations defense in Georgia? How should I proceed before I answer the summons?

The statut of limitations could be anything. Most credit cards are based in other states, often with long statutes. In Georgia, a contract under seal has a 20 year one, so it is possible the statute has not run. We would need to see the credit card agreement, as amended, to know the applicable time. It probably was an insert in a bill.

You have been sued - get a lawyer. If you do not raise your defenses properly, you may very well end up with a judgment against you. Altneratively, if the debt is valid and you owe the money, why not pay it? Likely, the creditor may agree (in writing) to not report it negatively.
