Health club contract

Here is a email I sent to my health club: ----To the Owner of (name of business)

Dear Sir,

On July 10 2008 I entered a 1 year agreement with (name of club).

My contract says Paid in full at the top.

I made it explicit that I wanted to pay in full for 1 year with no future charges and no future billing.

These were my requirements for entering into this agreement.

I was told that this would be the case.

I paid $298.00 for 1 year membership.

If I had been told the price was $298.00 plus some other charge, then I would have based my decision to buy a membership on that information.

Please remove the charge from my account at your billing service.

Have them send a statement indicating the account is paid in full.

Thank You.

They are trying to charge a ''club maintenance fee''.

My question is : If I refuse to pay, can they hurt my credit? How can I get them to remove the charge from my bill? What prevents them from making unjustified charges? Even if they take me to court and the judgment is in my favor, it seems like they could hurt my credit in the mean time.

You state what you meant, and what you "made explicit," but fail to say anything at all about what the contract says, if anything, about other charges and fees that could be charged later. Presumably (since you are posting here and sending emails), you also done the obvious and discussed it with the club, but you fail to provide their position or explanation. With half the facts, you can't get much of a response.
