Legal Question in Credit and Debt Law in Georgia

I was hurt at school when 11. I am now 23. A collection firm mistaking Me for my Dad, we have the same name, obtained a default judgement against me when I was 11 for an unpaid ambulance ride. Now I am grown and they are attempting garnishment of my wages. A. At 11 I am a minor B. I was never told or notified of the suit.

C. I could not defend my self at that age.

D. Is this LEGAL.

E. It was not my responsibility to paid this bill. What should I DO , THE CLOCK IS TICKING to stop the unfair garnishment

You should get a lawyer to traverse the garnishment and make a motion to set aside the judgment, and you stand a good chance on these facts to collect damages from the lawyer who filed and the plaintiff.

I agree. I am not sure that the creditor mistook you for your dad. The judgment was probably entered against your father, not you. But because you have the same name, they are trying to garnish your wages. I would have to see the garnishment paperwork - usually a garnishment summons is directed to the employer with the debtor's social security number. Maybe not. Attorney Ashman is right - you need to get a lawyer and file a traverse to the garnishment.
