Legal Question in Credit and Debt Law in Georgia

judgement against me

There was a judgement awarded against me because I did not show up for court and I was a 3rd party defendent named in the case.

I was never asked or requested to show up in court on the day of the trial, and did not know I had to.My friends lawyer said they had no case.

They were awarded a judgement in KY.

I wrote the Judge stating that the findings were bogus, and he never responded.

Now it has followed me to georgia were I reside.

What can I do or should I do ?

Is there an appeal process?

Help please ! ! ! !

Bill

Re: judgement against me

You can get a lawyer in KY to look into it and see if there is a way to overturn the judgement, but based on your note it may be a longshot at best. You made several errors. If you have claims against you in a trial, you don't wait for an invitation to participate. Your failure to appear probably guaranteed the judgment against you. Moreover, you should have obtained a lawyer and not relied upon your friend's lawyer. Judges will not respond to letters claiming the claims were "bogus." Defending at the trial was the time to show that. Most likely, any appeal time (perhaps 30 days after the judgment) has long since expired. Either get a lawyer to look into it, or perhaps you can make a deal with the creditor to pay less now and avoid garnishment.
