Law firm wanting due balance and she can't pay
My daughter had an operation to remove a non -cancerous tumor. she didn't have health insurance. The hospital set up an account for her to pay monthly. Soon after, her work hours were cut drastically.
She's 35, single, pays rent and utilities.
A law firm sent a letter, stating that she owes the full balance of $6,131.04 now.
I am unable to help her with it.
She knows that her wages could be garnished, but she is very worried that the law firm might take her truck and sell it to clear her account.
The Ford truck is in excellent condition, paid for, and likely worth the amount she owes, if not more.
My question is, will/can the law firm take the truck? Is that a normal prcedure for them before garnishment?

Once they sue and obtain judgment they can (1) take the vehicle, (2) take her bank account, and (3) take part of her paycheck.
Instead of waiting for all that to happen, she needs to see a lawyer immediately and determine her options. For example, she may be able to wipe out the debt in bankruptcy court. If she is in metro Atlanta, have her give us a call.

It is unlikely the vehicle would be taken even if they obtained a judgment, since exemptions would cover most or all of it. If this is the only significant debt, it would likely be ludicrous to consider bankruptcy. The law firm still wants the money, so they might accept a payment plan. If more work hours, or a second job, is possible, that should be considered.
