Legal Question in Credit and Debt Law in Georgia

loan debt

I have just been served for a $6000 loan. I made payments for 2 years and now I have defaulted. I am being sued for the full $6000. Can they do that and do I have to appear in court? I live in Atlanta.

I am not sure why you think they could NOT sue you if you have defaulted. If you do not properly defend, they will get a judgment.

When you default on a loan, you should expect that the lender will do exactly what they did here, accelerate the loan and sue you. You now need to get a lawyer within 30 days. Assuming you owe the money, defending the suit won't help, so your choices would be to pay the lender, or, in some cases, to file bankruptcy. It is unlikely that you have other options, but a lawyer can look at your paperwork and answer that.
