Legal Question in Credit and Debt Law in Georgia

Marital Responsibility for Debt

We made a personal loan to a man for the benefit of both he and his wife when he lost his job. The loan helped him to avoid foreclosure on his home and provided him with a car to pursue employment.

The man agreed to repay the loan over time and has failed to meet his obligations despite repeated attempts to collect. Is his wife also responsible for the repayment of the loan?

From the way you worded your question, the answer is, not likely. By the way, do you have a promissory note in writing?

This answer, though responsive to the question is general in nature. It is not designed to be and should not be relied on as your sole source of information when analyzing and resolving a specific legal issue.
