Legal Question in Credit and Debt Law in Georgia

Medical Bills

My daughter is a student in Savannah GA, we live in WV. She went to a chiropractor. They told her she could make payments on what the insurance didn't pay. He didn' help her and she stopped going. She has offered to pay $20.00 a week but they say they will take her to small claims court tomorrow if she doesn't pay balance today. She makes 8.00 an hour and works 24 hours a week. Can they do this, what rights does she have in the state of Georgia

Re: Medical Bills

You state nothing about the terms of any agreement so we can't guess. Generally, a creditor cannot be forced to accept a payment plan unless that was agreed upon in the beginning. Either way, the Judge will figure it out before we can.

Re: Medical Bills

Note that an unpaid bill (and certainly a lawsuit) will ruin her credit for up to seven years. For years she will pay higher interest for cars, homes and so on, and suits may affect her employment in the future. So if she owes it, she needs to pay it.

If she owes it, she can be sued. After losing her paycheck and bank account can be garnisheed.

You didn't mention the size of the bill, so I can't suggest other options, if any.

Re: Medical Bills

I am not sure that I can help at all. I do some work in the Savannah area. Your posting is unclear if there is an actual trial date or not. If there has not been a trial date yet the chiropractor may be willing to negotiate however if he has a judgment probably not. My contact information is below.
