Legal Question in Credit and Debt Law in Georgia
Payday Advance
I took out a payday loan for $400 in antoher state in 01/07. I was paying $54 twice a month and I stopped paying on it in 07/07. They sent a letter threatening to take civil action after the first late payment. I haven't heard from them since and now they have started calling back threatening to take me to jail. Can they do this? What action can they take against me being a resident of GA?

Re: Payday Advance
Even on legitimate debts, the debt collector has to follow Federal and State laws in collecting that debt. In civil matters such as this, such company or debt collector cannot just put you in jail. I would need more details of what exactly the company has told you, but it seems that the company may have violated Federal and/or State laws. You can pursue a claim on such debt collectors. Please feel free to contact me or any attorney who does this type of work about any potential claim you may have.
