Legal Question in Credit and Debt Law in Georgia

I have several payday loans aquired online & one in south carolina. it has become so overwhelming to i tried to setup pmt.plans because they have charged my bank so many overdraft fee's and I can't pay my household bills. I am a ga resident how do I handle paying over $700 every two wks to payday loans, can't pay car pmts or anything.

NEVER take out a payday loan. These people are worse than Tony Soprano!

NEVER give anyone your banking information or allow them to automatically debit your checking account whenever they feel like it. The only remedy is to close your bank account and get an account elsewhere.

Once you get your finances on track (and you need to pay the car loan and your rent first), go and pay an attorney for a 30-60 minute consult and allow him/her to review the loan documents. Payday lenders have to comply with strict requirements and the lender may have violated the Georgia laws particularly if the payday lender is located out of state. Depending on the circumstances, you may not even owe the money if they have been repaid.

Failing that, payday loans are like any other unsecured debt. Maybe they will sue and maybe they will send it for collection. If it goes to collection, you may be able to negotiate a settlement for less than what you owe. Bankruptcy is a drastic remedy not without its own consequences and should not be entered into unless you have a great deal of other debt (over $10,000).
