Legal Question in Credit and Debt Law in Georgia
Protect my mother from lien
I live in GA. My mother who cosigned for me to get a car lives in FL. The car was recently repossed and sold leaving me with a balance of 6338.36. I called the creditor to make payment arrangements however they advised what I proposed was unacceptable and that they can not accept anything less than $1000 in three days and $300 per month. I advised that it is not feasible for me to come up with that amount of money in three days. The creditor told me that I had to come up with the money and that they already did the research on my mother and her assests and that they will put a lien on her house inorder to get the money if I did not cooperate. I explained that my mother is a maid and that she cannot take out and more money on her house right now because she already had to take a out a loan for other reasons. He refused to give me an address and explained that there was no one else that I could speak with because he had the final word!
What can I do to protect my mother?
I really appreciate you your assistance in this matter!

Re: Protect my mother from lien
Number one - NEVER talk with colectors by phone. Any arrangements should be by mail only.
If a creditor sues your mother and gets a judgment, that can be used to go against the home.
