Legal Question in Credit and Debt Law in Georgia
I just received a summons from an old credit card debt from capital one back. There "attorney" is out of marietta, ga. I am in Macon,ga now. I know I have to pay the debt, but after being laid off from a job last year its been a horrific struggle. There is NO court date on here and I have 30 days to respond. I DID call the collections/attorney's office today and asked if I could make payments, and they said yes. I then asked once we agree on a amount, will that stop all the legal stuff and make it where I do NOT have to go to court or anything and they said YES. I have to call him back tomorrow to set up payment plan, BUT do I still HAVE to go to the local courthouse or no since I am in talks with the attorney's/debt collectors office?? Thanks Chris

Unless you have a deal in writing within 30 days and either a dismissal or similar paperwork from the court, you will have been hoodwinked and will get a judgment against you. At this point you need to see a lawyer. And you need to do it immediately so that you take proper steps and everyone that you have taken thus far is wrong.
Don't trust anything a collection lawyer tells you. Consult with a local attorney.
