Legal Question in Credit and Debt Law in Georgia

Repayment of judgment

Several years ago I was unemployed and all my bills got behind. Two of my credit card accounts were sent to the same collection agency. I've been faithfully paying on the larger bill and should have been done paying my debt last year. But I found out last year that my payments had not been applied to the larger account but to the smaller one which I was garnished for in 2004- 2005. Last week I pulled my credit report and found that the larger one (which supposedly has a judgment on it but I've never seen that on my credit either) is no longer on my credit. This company is trying to collect $5k from me that I no longer owe b/c they have misapplied payments. I've been going back and forth with these folk for a year now and I'm frustrated. How do I get these people off my back? Am I still responsible for paying the larger debt now that it has been removed from my credit? Also, how do I get them to report the judgment for the smaller debt as being satisfied? According to this company, they have no record of them ever garnishing my wages. The company has requested that I send documentation that I was actually filed a dispute with the credit bureaus regarding this matter.

Re: Repayment of judgment

I am not sure why you think you do not owe a debt merely because it is not on your credit report. That makes little sense. It is unlikey that your credit card agreement provided that. Beyond that, you need to do some accounting to see what you have paid, and request an accounting from the collector if there is a discrepancy.
