Legal Question in Credit and Debt Law in Georgia
Repossession after payment made
Thursday morning I had a balance due to ford motor credit which 385.00 was actually past due. I mailed that 385 that was past due thursday. Yes, I should have western unioned it. A repo guy shows up that night I wouldn't let him take it and showed him the reciept. He asked for copies which I made him and he said he would call ford and let them know. I told him that the next day I would western union 100.00 to show good faith. He said not to worry he would call them and not come snatch it in the middle of the night, that was thurs. Friday nite he came and took the vehicle. He never called ford. Now he has the car, tags, and belongings (i know htis is his job), but here's my actual QUESTION....I have a title to the car, apparently mailed by mistake when we moved from missouri to georgia and we registered the vehicle. There is no lienholder and we are the listed owners. Will this help me get my car back? OR is there another way to get it back? ford is not being nice. thanks.

Re: Repossession after payment made
The title lien notice provides NOTICE of the lien to third parties, and prevents you from selling the vehicle with the lien. The title notation does not create the lien. As between you and the lender, your loan documents and security agreement (unless they are unlike all others) allow them to repossess after a default. They will obtain a new repo title.
