What are my rights regarding a garnishment on my wages that pays a mortgage payment for a home that

my 74 year old father lives in?

None. You have a judgment against you. Had you done something about this when you were sued, maybe things could have been resolved. Instead, its now gone to wage garnishment and in my experience, once garnishment starts, creditors have very little incentive to settle a debt.

Do what you should have done long ago and see an attorney. It may be that bankruptcy is your only option. If there is a problem with the judgment (like it is resulting from identity theft or you have some other reason to set aside) you might also be able to stop the garnishment.

In Georgia, a creditor is able to garnish up to 25% of your disposable pay (gross pay minus required deductions like things for taxes). Whether you pay for a mortgage out of your net pay is your business. However, it has nothing to do with a creditor and they simply do not care.

Sorry, but you waited too long here and now there aren't many options left.
