Contact a bankruptcy attorney as soon as possible.
Either pay the bill, or see a bankruptcy lawyer. There isn't a plan C for most people (plan C is defend the case if you actually don't owe the bill by getting a lawyer and answering the case).
If you are eligible for bankruptcy, you may be able to get rid of it, and other bills. Be sure that whatever you do you do in less than 30 days after you were served.
If you have a lot of debts (over $10,000), I would recommend bankruptcy. If you don't have a lot of debts, then I respectfully disagree with Attorney Ashman, as there may be a Plan C.
Getting sued is not the end of the world for you. Debts can be settled at any time - either before you get sued, after you get sued or even after judgment has been entered.
How much is the debt? How much of the money do you have to put towards the debt? Do you work for someone else? Are you self-employed? What is your source of income?
Depending on your circumstances, you may be able to save up until you have 50% of the funds available and try to resolve the debt. Its going to be at least 60 days before a judgment is entered so you have some time to build funds. Failing that, if you are at risk of wage garnishment, you can always work out a payment arrangement pursuant to which the creditor will not garnish yhour wages or freeze your bank account provided that you make your payments. Payment plans are generally anywhere from 2% to 4% of the debt.
I know that you say that you can't afford an attorney. I give free email consults and could give you better advice if I knew the specifics of your circumstances. For a reasonable fee, I also can assist in resolving your debt by negotiating a payment plan or an outright settlement. Please email me at [email protected] if interested.
