Legal Question in Credit and Debt Law in Georgia

served summons on old cc debt in GA

I was recently served papers by a law firm via the sheriff, a ''complaint on account''. I have 30 days to answer or they get a default judgement. I have not made a payment since March of 2002. Is it out of the statute of limitations? It used to be 4 years in Ga, but now I think it is 6. Is it 6 years from last payment?

Without your card agreement and documents, no one can tell you what state's statute applies. The best option is to reach a written agreement to pay the debt, perhaps with an agreement they will not report it on your credit report.

In Georgia, actions for breach of credit card contracts have a 6 year statute of limitations.
