Legal Question in Credit and Debt Law in Georgia

Can I settle in small claims?

My lending company send me a letter that states I am in default on my mortage. The total amount due by their own letter states that I was still $684 in default,so I had to respond within 30 days and I did. I sent a check for the full amount of $684 and wrote ''pay in full'' on the check. The check was return along with another letter that said I now owe over $1800 because the loan had accelerated due to legal fees, add on interest and etc. My question is would it be better for me to settle the past debt in small claim court with the evidence of letter and the offer I made to wipe out the debt?

Re: Can I settle in small claims?

What you owe is determined by the contract you signed. You fail to mention what it says about the fees mentioned. People who OWE money typically do not sue -- they get sued.
