Legal Question in Credit and Debt Law in Georgia
spouse's car loan
i live in georgia with my wife, joinly own a house. my wife took out a car loan solely in her name to buy a new car , then she lost her job.
if she default her car loan, will creditor be able to go after our house or any marital asset ?
can she quitclaim the house to me BEFORE defaulting car loan to prevent creditor going after our house ?

If a creditor gets a deficiency judgment, they possibly can place a judgment lien on the real property. Transferring real property to shield it from creditors is called a fraudulent conveyance.
