I am being sued for a medical bill
I was working as a security guard, and on Christmas Eve 2007, was rushed by ambulance to a hospital, experiencing symptoms of a heart attack. This was later diagnosed as a panic attack, and I was discharged. My company never filed the bill under Worker's Compensation, even though I was working at the time the incident occurred. I must now file an answer, and any counterclaim for the summons. How do I ask that my now former employer be held responsible for these charges and not me? Upon my return to the same location several months later, I experienced the EXACT same symptoms, but now believe them to be the by-product of an allergic reaction to chemicals used onsite. My company should have filed a report with Worker's Compensation, but it was not until I quit, that I learned no report had been, nor would be filed regarding the situation. Please respond ASAP, as other resources have failed to follow through and I have until Dec. 4th to file my answer/counterclaim. I desperately need help.

In virtually all cases, a person is primarily responsible for the medical care they receive. While you might think someone else should cover the cost, and you might ultimately be correct, that is normally not the responsibility of the hospital/doctor to sort out. They treated you - they expect you to pay. Thus, you need to properly handle the lawsuit and not wait on anything else. Perhaps a workers comp lawyer can assist you - post the facts about your employment situation under that category, but again, that is not going to resolve your debt for the medical bills and you still need to answer. See a lawyer, either way.
