Summons & complaint served

I have been served a summons and complaint on an outstanding credit card bill that was charged off by the original credit card company in September of 2001. What is the statute of limitation in Georgia on this and if it has run out should this be dismissed when this is brought up in the answer that is filed?

The statute is generally four or six years for debts, depending on the nature, and the date "written off" is not necessarily the date upon which is starts. Since you have been sued, it is prudent to get an opinion from a lawyer who can review the specifics, rather than rely on a board like this. Alterntively, perhaps in exchange for honoring the obligations you have made, the lawyer for the creditor will agree to not report further negative information on your credit report.
