Legal Question in Credit and Debt Law in Georgia

A Summons

Have been summoned to file with clerk of the Superior Court, in a suit of nonpayment of credit card debt in the amount of $8871.13. My husband has been laid off since Sept./07 and we have no other income except his. This credit card is in my name, the wife. We simply can't pay this bill, we are struggling to just buy food for our family! I am sending a ''debt validation letter'' monday to have them produce verification of the debt. What should my next step be? We have no real property, rent our home, only have one vehicle that is being paid on, not owned outright. What can they do to us legally? THanks for your help, MG

For many years to come they can seize your future income and assets. Instead of sending the letter (don't do anything like that without seeing a lawyer) you may want to consider bankruptcy so that when there later is a family income it will be safe. A letter does NOT help you with the summons. See a lawyer ASAP.
