Legal Question in Credit and Debt Law in Georgia
we had our truck repossed by title pawn due to family emergency. how many days do we have to get back
1 Answer from Attorneys
First of all, as youhave learbned, no one should ever deal with Titkle Pawn copmpanies. They are poison, and their interest rates are worse than some Mafia loan sharks. Get your car paid off and never make that mistake again. Some day the Georgia legislature will ban this disgusting industry, but until they do, you have to smart enough to stay away.
Georgia law gives you a 30-day grace period to redeem your vehicle prior to its repossession and auction. Redemption involves paying the WHOLE principal, fees (including repo fees) and interest associated with the transaction. If the pawn shop is closed on the 30th day, Georgia law treats the next day the pawn shop is open as the 30th day. The pawnbroker can't sell your vehicle during that time. The clock starts ticking on the day after the maturity date; however, the pawnbroker can extend the maturity date if he does so in writing.
You may be well served to also discuss our situation with a bankruptcy lawyer as that may give you other options.
