If your behind a vender but you pay what you have every month can he still sue you

You can get sued if you are not paying what you owe or breach your agrement to pay. You don't get to force the other party to accept your terms that you come up with after the fact.

Yes, I am afraid that the vendor can sue you regardless of whether you are making partial payments or not, provided that partial payments are not in accordance with the contract terms.

What I would do is try and work something out with the vendor. Did you have a written agreement with the vendor? If so, what does it say about modification of the agreement? If not, then I would propose that you have a written agreement and get the terms of repayment in writing.

I would approach the vendor and appeal to his desire to work with you as a matter of economic good sense. Sure, he can sue, but suing costs money and if you are paying what you can, it is better to allow partial payments rather than spend money and either put you out of business or in bankruptcy and get no payments.
