Legal Question in Credit and Debt Law in Georgia
Does a writ of fieri facias ever expire?
1 Answer from Attorneys
Judgments are enforceable in GA for a period of 7 years and then they go dormany. They can be revived though for a period of up to 3 years after that. In answer to your question then, writs are good for 7 years after the date of issuance, subject to renewal. While it is active, your wages can be garnished, your bank account levied and anything you own free and clear can be seized and sold.
If you are a defendant with a judgment, I suggest you consult an attorney about what can be done. Depending on the debt, possibly a bankruptcy attorney or consumer law attorney. If you are a plaintiff who has recovered a judgment, then you also need to consult a collection attorney to help you enforce the FiFa.
