Legal Question in Criminal Law in Georgia

In 2007 I was accused of sexual battery by an adult girl. The investigator on the case wanted me to come "talk" to him. I just answered "basic" questions and then sought the advice of an attorney who said that I did not need to speak to him, so I didn't. The investigator says he spoke to the lawyer and the lawyer was uncooperative. Now, in 2011, the came out to my house and arrested me, with a warrant. The obtained a search warrant for my DNA and swabbed my cheeks. They are saying that the ran dna thru the GBI and now need mine for confirmation it is from me. The charge as it stands now is just sexual battery and NOT aggravated sexual battery. The charge against me is a misdemeanor. Is there not statute of limitations on misdemeanors? How can they come and do this 4 years after the alleged incident? I have had a few contacts with police since the alleged incident and no one has ever said anything about an arrest warrant in Dekalb for this incident, at a local college.

Yes there is a statute of limitations. Now you can stop writing the same question over and over. No one is stupid. You think the entire police force is stupid. You think you are smarter than the entire police force. No one on the force figured out the statute of limitations had run, just you. YOU NEED A LIE: THERE IS A STATUTE OF LIMITATIONS.
