Legal Question in Criminal Law in Georgia
My 16 year old went to court for a trespassing charge and the juvenile judge ordered an informal adjustment instead of finding her guilty. He ordered her to 6mo probation and community service. She is not guilty and was not found guilty. So what exactly does an informal adjustment mean? We declined any previous offers from the Prosecutor because they wanted us to agree not to pursue a civil lawsuit against the sheriffs department. Can we now pursue a lawsuit??

You need professional advice for your child (not limiting that to just a lawyer). If you were not involved in the process to know exactly what happened in court, before something was agreed to, something is missing from the picture. Your child did not get probation, community service and an informal adjustment because she was innocent and most likely your child admitted the conduct in question. With that, sue the Sheriff's Department for what?
Informal adjustment is not a finding of not guilty. It is a pretrial diversion which if completed successfully closes the case without a record.
