Legal Question in Criminal Law in Georgia

My 19 year old daughter and I got in to a little fight a few months back. She didn't like what I said so she hit me in the eye. I over-reacted and hit her back, one time. Then she went crazy and hit me several times but I never hit her again. She called 911 and they came, heard both of us, and arrested her for battery and me for simple battery. If we both go together before the judge and ask him to drop all charges, will he? Or better put, what would be are chances if we did that? We were both charged under the family violence act. Somebody please help! Any advice will be greatly appreciated.

It's not up to the judge. It's up to the prosecutor whether to proceed with the charges against you. I would STRONGLY recommend hiring 2 Georgia criminal defense attorneys -- one to represent you and one to represent your daughter.

Judges don;t drop charges,. And what you say without counsel could land you in jail.

Both of you have been charged with a crime, and each of you badly needs a lawyer. You CANNOT use the same lawyer.

Each of you could be jailed for a year and fined $1000 and have a criminal record for life.

You are several months late in not already getting counsel. You need counsel immediately.
