Legal Question in Criminal Law in Georgia
If a 16 yr old girl is Questioned by an Investigator, and tells him her Uncle fondled her breasts about 2 yrs. ago, and there were no witnesses, no other evidence at all, and then the 16 yr old refuses to testify against the Uncle, would the case go to Court? And if so, would the DA have enough evidence to convict..Thanks!

There is a witnesses, the investigator that took the statement.
I highly suggest you retain an experienced criminal attorney ASAP.
Contact my office at 404-522-0341 if the DA brings charges against you.
Good luck!
the case would go to court, but the prosecutor would not be able to prosecute the case unless the girl testified. Let me suggest that if the prosecutor uses resources to get an indictment, arrest the defendant and schedule hearings, then the prosecutor will locate the victim and make her testify.
