Legal Question in Criminal Law in Georgia

Accused but it wasn't you

My boyfriend recently found out he had a warrant for him and turned himself in to find out wwhat it was for. We then found out that he had four felony warrants on him when we only knew of one. He has been taken in . There is a person who spoke to the person who robbed the place that my boyfriend is being pinned for. This person that spoke with the robber works at the establishment. If he was to say that my boyfriend is not the person would that clear him up or would he have to wait til he goes to court?

Once someone is arrested, they are put into the system and indicted charges are likely to follow. Don't forget that an arrest is based on probable cause, so there has already been an investigation by law enforcement into your boyfriend, which resulted in enough evidence to arrest him. Theoretically, if the eye-witness were to make a sworn statement that your boyfriend was not the robber, the charges should be dropped. This could be done either in court, or by a written affidavit.
