In order for your son to avoid being charged with any type of sexual offense (statutory rape, child molestation, enticign a child), the girl must be 16 years of age or older. If she is seventeen there should be no problem. However, if the parents do not like your son, and the girl is still living with her parents, her parents might create problems for your son - i.e. interference with custody, temporary restraining orders. Good luck.
