Legal Question in Criminal Law in Georgia
Hi, I am trying to get in the Army. When I was 17 I was charged with a felony, aggravated assault, back in 2004. The Army Recruiter I am dealing with says that since I completed anger management to have my charge dropped, to them, it is an admission of guilt. It is labeled as a conditional discharge and Nolle Prosequi motion was filed. I just want to know since now that I am 25 and have been in no trouble, if the court can change the court records in my favor to maybe help me in my pursuit of joining the military?

Change the record to what? In 2004, you believe that you had an aggravated assault. I suspect that while you may have been initially arrested for aggravated assault the charge was reduced to simple assault in order for you to be considered for a conditional discharge. You were given a condition of completion of anger management, in exchange for dismissal of charges. Therefore the charges were dismissed. Are you now hoping that your record will be expunged? It will not. The recruiter should just be honest with you, he does not want you. Period. You can chase this dream if you wish, but your criminal record will remain the same.
The Army, and these days most employers, will reject you for a criminal record. Aggravated assault is essentially attempted murder, so it should not surprise you. You will need to look for employment that is not wanting to focus on your record.
Get an agent and a real estate lawyer. Analyzing a deal like this, which necessarily involves quite a bit of paperwork, is far beyond an internet forum (and you should not expect to make your decision based on an internet forum).
