Legal Question in Criminal Law in Georgia
Asked a question earlier, and though admonished for not presenting enough facts (which lawyers love) and for my general curiosity, I am back. Rephrased question: My boyfriend was arrested a year ago for simple robbery while his friend who actually committed the act was arrested for armed robbery. My boyfriend did not even witness the actual crime and was released on bail shortly thereafter, but his friend was not given the option and has since remained in custody. My boyfriend has since received a subpoena to testify in court in a few days, but he's obviously worried about incriminating himself. Is it likely that the prosecutor will target him as well, even though the victim himself has already identified the defendant? What usually happens in these types of situations?

You did not get the points. One, he needs a lawyer to answer the questions. Two, he does not need a girlfriend (or anyone else) posting details of his arrest and possible involvement in a crime on an internet message board.

The moment he got arrested he needed a lawyer. He certainly needs one now. Unless he is complete fool he will retain counsel who can help him decide if and when and how to testify.
That answer is what matters and it doesn't change even with more facts. No lawyer can guess what a prosecutor will do. But when someone gets arrested, he has a potential to be prosecuted. Certainly you hired him a lawyer then. Talk to that lawyer now.
