Legal Question in Criminal Law in Georgia
Is this battery?
My ex wife has custody of our daughter , age 17. I have custody of our son age 12. My question is this: The daughter keeps striking my son so thst he does'nt want to visit her.The mother does nothing to stop this or punish the daughter.Is'nt this considered battery?

Yes, but so is physical discipline. The real question is whether the battery is in violation of the criminal laws of the State of Georgia. More information is required, but it sounds from the tenor of your question that you feel her hitting of your son is not justified.
