Legal Question in Criminal Law in Georgia

Can my boyfriend avoid a prison sentence

My boyfriend's house was raided in November while he was at work and he is now awaiting a grand jury indictment for manufacturing methamphetamine. His property has several rentals on it and the evidence seized was in the woods, accessible to many other people. The lead investigator was an old high school enemy who has lied in court at the preliminary hearing and was also in the judges chambers before the hearing. The evidence has been ''disposed of'' and now only photos exist according to this invesigator. Does any of this sound strange?

Re: Can my boyfriend avoid a prison sentence

He has quite a few hurdles to overcome, and your fact discussion mentions nothing about his background and prior record, if any. It would be far better to have friends in law enforcement than to have enemies. On the other hand, this can sometimes work to your advantage in a criminal investigation. I agree that things sound strange, but things are never stranger than in a criminal prosecution. Does he face any kind of a minimum mandatory sentence?

Obviously he needs an attorney and his attorney needs talent, skill, ability and luck. All are costly commodities. Without this combination it is not likely your boyfriend can avoid a prison sentence. With them it is in no way guaranteed.

One would need a lot more information to even begin to give you a real opinion. I assume your boyfriend is in custody. If so this adds to the difficulty in discussing the case with him.

Please advise if I can be of service.
