Legal Question in Criminal Law in Georgia

Case dismissed but will it be on my record?

I was taken to jail because me and my boyfriend was fighting. Neither of us pressed charges, We went to court immediately in the morning, and the judge just told us to stop fighting and dismissed it without any charges. I did not get any court decision paper or anyhing they just let us go. But they took my SSN # and fingerprint while i was there. Will this be on my record? Also, do i need to disclose that whenever i am filling out a form that ask me if i am ever convicted/charged. In this case i am applying for U.S. citizenship and a real estate license.

Re: Case dismissed but will it be on my record?

You should get a certified copy of the court order showing that your case was dismissed. Call the clerk at the courtroom where your hearing took place. This is important especially since you are an immigrant. You want to have this documentation in case someone at some point claims your case resulted in a conviction - for example, immigration authorities giving you problems if you attempt to re-enter the U.S. after going abroad.

The record of your arrest will stay but will not necessarily cause a great deal of problems for you. If you apply for U.S. citizenship or real estate license it will most likely come up during the application process where you do not want to be caught lying about anything. You might need to do some explaining - blame everything on your boyfriend! - but you should be fine assuming your criminal record is otherwise clean.
