Legal Question in Criminal Law in Georgia
Can this case be dismissed?
Last year, my husband was charged with criminal damage to property because he got drunk in a restaurant and tossed the cash register on the floor. He made arrangements with the owner to pay it off (it will be paid in a couple of months). The owner has no interest in pressing charges and is fine with the payment arrangements. Can the case be dismissed or will he still face charges? It is Cherokee County in GA.

Re: Can this case be dismissed?
Cherokee is a tough county to get cases dismissed in, but if the victim (the restaurant owner) is unwilling to assist the prosecution and makes himself unavailable as a witness for trial, dismissal is possible.
