Legal Question in Criminal Law in Georgia

Hello. I think I might have a case of extortion/blackmail on my hands. By the way, I live in Georgia, and am a 19 year old college student. My parter had photos on her computer of her and I going out. Another man, her sister's boyfriend, logged on to my parter's computer, stole those photos, and has them on my parter's sister's computer, and probably his computer as well. I fear that he will use them to discredit me and/or ruin my reputation in my community and others as well. Is there any legal action I can take? since he has photos of my person without my permission?

You can file an injunction if the photos are published to have them removed from where ever they appear. You can file an injunction to make sure they are not published. However, there a million things I do not understand about your factual scenario: (1) how do you know the photos were "stolen"; (2) why do you think you will be blackmailed or extorted, when there have been no demands made; and (3) assuming the photos show you in a compromising position, to whom is he showing the photos to discredit you when you are only 19 years old. You are not in your career at 19, and if you are in school, who will care. I wish you the best of luck.

First, although you leave us to guess what you mean by "going out," the blame starts with you and your girlfriend. Your reputation was at risk the instant pictures were taken, long before anyone else got them. The internet is not new, and someone in college accepts the risk of having pictures they don't want to get out. Second, you fail to tell us who owns the pictures and what the owner did with them. You tell us about pictures involving your girlfriend were taken from her computer. She may be the one who has the complaint, or she may be the one who allowed others to get copies of the pictures. Third, the fact that you are in the pictures does not mean you control what happens to the pictures. Finally, you raise blackmail and extortion but don't state one fact to back up those claims. The bottom line is that you or your girlfriend can hire a lawyer and spend a few thousand dollars going to Court to stop people from distributing the pics, or deal with the consequences of your actions in having the pics where someone can get to them.
