Legal Question in Criminal Law in Georgia

Caught in the Line of Fire

I had a domestic dispute with a longtime lover. I went to his home to simply give him a piece of my mind. I rang the doorbell. He didn't answer although I knew he was at home. I went to my car and I blew my horn three or four times. He still did not come out. I pulled away. When I got to the end of the driveway, I heard what sounded like a gunfire. I looked in my rearview window and saw he was standing their and I could see flashes from a gun. He fired at least five shots in my direction. My car was not hit. I was not hit. Was it unlawful for him to fire on me although he knew I was unarmed and only wanted to fuss? Anytime someone fires on you they run the risk of really hurting you.

Re: Caught in the Line of Fire

Are you kidding me? This could be as serious as attempted murder if he only missed because he is a terrible shot. It is certainly an act of assault with a deadly weapon, and there may be a few other potential crimes, too. Send me an e-mail with your address and I will do a little research on other potential charges. In the meantime, find out if you can if there are any witnesses that saw or heard the shots. You defintely need to go to the police and file charges on this one. I will try to assist you in outlining all the charges you can claim. And, for god's sake, steer completely clear of him and if he comes anywhere near you, call the cops immediately and get away if you can. You also can sue him for this and obtain a restraining order requiring him to keep well clear of you. If you think he has any money to collect, you might want to consider it. You also could go to the local mental health service and file an affidavit that he appears mentally deranged and is a danger to others. They can investigate, take it before a magistrate, and have him ordered into the mental ward for observation and evaluation.
