charged with criminal trespass - not posted - in a cul-de-sac

My boyfriend and I were arrested for criminal trespassing in one of the new developments in Walton County.

There are a few houses being built in the very front of the development but we were no where near them. We were not messing with anything, we were just looking at rocks and picking up cans the workers had thrown out.

There is a dirt service entrance that cuts off the main road about 200 feet from the entrance to the development(off the same main road)and goes around to the cul-de-sac at the rear of the development, the one we were in at the time of arrest. We went down the dirt service road and came out in the cul-de-sac.

We were in there for at least 20 minutes before the cops showed up. The cops saw that there was no damage to the development, and that we weren't harming anything.

There aren't any ''no trespassing'' signs in the development. we have been going there for a year or more and have never been told that we aren't allowed to be there.

Is there validity to the Criminal Trespassing charge?

It appears you may have some excellent defenses and a case that might be won on negotiating with the DA's office.
