Legal Question in Criminal Law in Georgia

Charged When Innocent

I really don't know what category this is supposed to be in, I'm only fifteen.

I know a person that was alleged to have a gun and a hitlist at my school. Nothing was found on the student or any of this student's friends. This student went through a tribunal and was found not guilty. It is recorded on tape and I believe a few papers that this student was found not guilty. This student has had charges pressed before the tribunal by the school. The school system has already found this person not guilty and allowed him/her to return to school functions and grounds. Now this person has to go to Juvenile court to attempt to get the charges droppped. Can charges still be pressed on this person even though the people pressing the charges has found this person not guilty on tape and documented?

plz answer this for me. I know this person well and am very concerned about this. The school system has really taken this situation out of proportion since the beginning and I am hoping that this won't end in disaster. Especially for someone that is innocent.

Thank You to whoever answers this.

Re: Charged When Innocent

Because of all the school shootings that have occurred in recent years, this is the type of case that can and will be examined by a court of law, even if the tribunal has already determined your friend to be not guilty. The reasoning behind it is to err on the side of caution and really make sure there is no threat or danger to any one in order to prevent another tragedy from happening. If there is evidence that your friend is innocent, the court will take that into consideration. The outcome will depend on the weight of the evidence of guilt versus the evidence of innocence.
