Legal Question in Criminal Law in Georgia
I was charged with simple battery. Thank You
I was charged with simple battery. The reason i got charged was because i
was defending my best friend's fiancee from getting hit by another male who
pushed her and attempted to hit her. The reason i got charged with simple
battery was because the police officer only saw me jumping on the man from
behind and repeatedly hitting him on the ground. After that an officer told me
to get off and to put my hands behind my back. I complied with everthing the
police told me, on the other hand the other guy i hit got beligerent because
he was intoxicated and mothed off saying racial slurs and spitting on the
officers. When we got to the police station he continued and got in more
trouble. The officers said i had a good chance of getting this dropped, but i
am really worried because this is my first offense and i am in process of
getting back in the Marine Corps to serve my country. So please contact me
ASAP through my e-mail because my court date is on the 21 july 2004.
THANK YOU

I gather from your question, you are seeking information as to how to approach this situation without hiring an attorney. It is my opinion that you ought not do so. However, if there is no option for you to either hire or seek the appointment of counsel to represent you, you might try to determine who is available to accompany you to the arraignment as a witness to what took place to verify your contentions that you did not initiate the attack, but responded to defend your friend's fiancee.
Usually at the first arraignment, you can ask to speak to the solicitor to determine if there is a way to informally dispose of the charges, or to see if there is a way to formally dispose of the charges which will not interfere with your re-entry into the military.
Again, it is not something I recommend.
