Legal Question in Criminal Law in Georgia
I got a citation in Gwinnett county by a sheriff the officer told me that she was going to charge me with a local ordinance. The ticket itself has been marked local ordinance and she wrote tag light required on it with no code section was written on the ticket.The recorders court has docketed the ticket as 40-8-23 (D) that is a state code ,My question is can they prosecute that ticket as a state offense when it was clearly marked local ordinance and the code section 40-8-23(d) was not written on the citation?
