Legal Question in Criminal Law in Georgia
Hello to whom it may concern
The scenario goes like this, I was charged with disorderly conduct on November 7, 2009. Even though this is a misdemeanor I was handcuffed and taken down town but released on summons. I was not read my Miranda rights. Do you think that this charge is worth me just taking the fine or do I have a chance at having this case dismissed based on them not reading me my miranda rights.

Not giving you your Miranda rights does NOT affect the charge against you. It only means that any confession you may have given is not admissible in court. No charge is going to be dismissed just on the failure to give you your Miranda rights.
