Legal Question in Criminal Law in Georgia
Criminal Trespass
I have been given an order of hearing for application of criminal warrant for criminal trespass, but none of the criteria apply to me (no criminal intent, no damage, not informed to leave). The owner of the property is not the person trying to have me charged, it is a relative. The owner knew that I was coming on to his property and thanked me for doing so.
Do I need to worry about this hearing? Can I just state that she hasn't proven any of the elements of the crime?

I'm not quite sure that I completely what you are trying to convey. What I am getting is that you went on property that you had permission to go on and someone else other than the owner took out a warrant. Doesn't sound right. Call me if you would like and explain furter.
