Legal Question in Criminal Law in Georgia

Criminal Trespassing with Criminal Property Damage

My Builder was recently arrested after a warrant hearing for criminal trespassing. He cut down a tree on my property, without my permission, and stole it. Where can I find similar cases involving criminal property damage due to trespassing related to a tree? What past cases can I research to help substantiate my criminal case?

Re: Criminal Trespassing with Criminal Property Damage

To do the research you are suggesting requires access to a law library. In most Countys there is a library of some sort in the Courthouse. Even better would be if you had access to Lexis or Westlaw where the research could be done on-line or by disk.

Of course a final source of the information would be to hire an attorney to represent you in the civil part of the claim for the damages you have sustained. I feel certain he could provide you with access to his library, or he would be willing to do the research for you, for a fee.

I hope this helps.

Re: Criminal Trespassing with Criminal Property Damage

Unless you have access to an online searchable database, such as Lexis or Westlaw, you would have to search for related cases in a law library, although it would be difficult if you are not familiar with legal research. Of course, an attorney could take on your case for you or you could pay him/her to do the research only.

With regard to the criminal case, the prosecutor would be responsible for the research and the case in general. However, if you are desirous of filing a civil claim, precedent would be helpful.
